Background to the truck cartel
The truck manufacturers MAN, Daimler, Volvo/Renault, Iveco and DAF have admitted to participating in the truck cartel as part of a settlement with the EU Commission. Only Scania did not take part in the settlement and instead filed a request against the imposed fines to the European courts. On 1 February 2024, the European Court of Justice (ECJ) finally ruled that Scania was rightly fined approximately EUR 880 million for its participation in the truck cartel. This confirms that Scania was involved in the cartel and is liable for all resulting damages. During the legal proceedings against Scania, the statute of limitations for claims against the company was suspended and therefore not in force.
In concrete terms, this means that although claims against the other cartel members may already be time-barred, all claims against Scania can still be asserted today - regardless of whether the truck in question is a Scania truck or a MAN, Daimler, Volvo/Renault, DAF or Iveco truck. The prospect of enforceability of claims for damages is difficult to predict. However, compensation of at least 5% of the purchase value per truck plus interest is quite realistic.
