As a rule, losses are calculated as deposits minus withdrawals. Winnings that were reinvested and subsequently lost are not included in the calculation. You are clearly affected if:

Operating and offering online casinos in Germany was prohibited until 30 June 2021 under Section 4 (4) of the Interstate Treaty on Gambling 2012 (GlüStV 2012), with only a few exceptions. Since 1 July 2021, online casinos are permitted only with a national license. Any online casinos that were offered before 30 June 2021, or that continue to operate without a national license — typically by providers from Malta, Gibraltar, Cyprus, or Curaçao — are illegal. Very few people in Germany were or are aware of this. As a result, any losses incurred under these circumstances can be reclaimed.
